Indemnity & Privacy Policy
Indemnity
To the fullest extent permitted by law, the customer agrees to indemnify and hold harmless
Studio Graze, its owners, employees, contractors, and agents from and against any and all
claims, demands, losses, damages, liabilities, costs, or expenses (including reasonable legal
fees) arising out of or in connection with:
● any breach of these terms and conditions by the customer;
● any negligence, misconduct, or willful act or omission by the customer or any of their
guests, vendors, or agents during the course of the event;
● any damage to property or injury to persons occurring during the event that is not directly
caused by the negligence of Studio Graze;
● any allergic reactions, illness, or injury resulting from food consumption where dietary
requirements were not clearly communicated within the timeframes stated;
● improper handling, storage, or consumption of food items by the customer or event
attendees beyond the recommended consumption period.
This indemnity survives the completion of the event and the expiration or termination of this
agreement.
Limitation of Liability
To the maximum extent permitted by law, Studio Graze’s liability for any claim, whether in
contract, tort (including negligence), statute, or otherwise, arising out of or in connection with its
services is strictly limited to the total amount paid by the customer for the services rendered.
Studio Graze shall not be liable for any indirect, incidental, special, or consequential loss or
damages, including but not limited to loss of profits, business interruption, or reputational
damage, even if advised of the possibility of such damages.
Nothing in this clause is intended to exclude any rights or remedies a customer may have under
Australian Consumer Law that cannot be lawfully excluded.
Force Majeure
Studio Graze shall not be liable for any failure or delay in the performance of its obligations
under these terms and conditions if such failure or delay is due to circumstances beyond its
reasonable control, including but not limited to acts of God, natural disasters, fire, flood,
pandemic, government restrictions, transport delays, strikes, or failure of suppliers.
In the event of a force majeure, Studio Graze will notify the customer as soon as practicable and
will make all reasonable efforts to perform its obligations once conditions permit. Where services
cannot be provided due to force majeure, the customer may be offered a credit or refund at
Studio Graze’s discretion.
